A chunk of the elder Midyette's money may eventually be needed to defend members of the Midyette family from accusations of murder.

Things began to get even worse for baby Jason's parents, father Alex Midyette, age 26, and his wife Molly, 27, the day after they first brought their child to the hospital.

At 5 in the morning on February 25th, police searched the Midyette residence and came away with photographs of Jason, computers, eight marijuana pipes and a small amount of marijuana.

A report from the physicians at Boulder Community Hospital was issued in early March about Jason Midyette's death. It stated that the child's injuries were due to "non-accidental trauma," and not due to "any pre-existing condition or unusual pathology." Alex Midyette's lawyer, Paul McCormick, said, "That was an emergency room doctor who was not a forensic expert, so his conclusion is very tentative. . . The parents adamantly deny any child abuse occurring on their part. . ."

A couple of weeks later, the Boulder Daily Camera published an article indicating that Jason Jay Midyette's 20-plus broken bones were "various stages of healing." Bones in both feet were broken, as were 11 ribs, just to name a few of the injuries cited. The same article in the Boulder paper stated that authorities had subpoenaed cell phone records for Alex and Molly Midyette between December 17th and March 2nd.
