BOULDER, Colo.(Crime Library) — Alex and Molly Midyette appeared in Boulder County District Court Monday morning and entered their pleas to child-abuse charges stemming from the 2006 death of their 10-week-old son, Jason.
At the start of the hearing the Midyettes' defense attorneys asked Boulder District Judge Lael Montgomery to postpone taking their clients' pleas. The attorneys requested that the judge first review the state's evidence and a motion filed by the defense, to determine whether or not to move forward with the case.

On Friday Paul McCormick, Alex Midyette's attorney, filed a motion asking that the case be dismissed because of unprofessional conduct on the part of the Boulder County District Attorney's Office. McCormick said prosecutors badgered and belittled witnesses during the Midyettes' grand jury hearing.
"Basically, the prosecution, lacking any credible evidence to indict the defendant, set upon a mission of character assassination," McCormick wrote in the motion.
Unfortunately for the defense, their motion to postpone the pleas was denied. Montgomery said she had already read the transcript and found there was probable cause for the Midyettes' arrests.

Following the judge's ruling, Alex Midyette, 28, entered a plea of not guilty to four counts of child abuse resulting in death. Afterwards Molly Midyette, 28, pled not guilty to three counts of child abuse resulting in death.
