BOULDER, Colo. (Crime Library) — Alex and Molly Midyette appeared in court Wednesday, the day after being charged with seven counts of child abuse resulting in the March 2006 death of their 10-week-old son, Jason.
Alex, 27, and Molly, 28, held hands, appeared to support each other, and even stole a kiss during the proceedings, as their lawyers argued with prosecutors over future hearing dates and ultimately a trial date.
In a courtroom crowded with spectators, Boulder District Judge Lael Montgomery reduced the home detention requirement of the Midyettes' bond and instead ordered them to be fitted with GPS tracking devices so that authorities could monitor the couple's whereabouts when they are away from their Erie, Colorado home.
However, the judge refused to completely lift, although she did modify, a bond stipulation that the Midyettes not go near children. Instead, the judge ruled that they were only barred from being around children—including family members—less than 2 years old.

The Midyettes' defense attorneys had argued that the restriction prevented Alex and Molly Midyette from visiting with some of their nieces and nephews. The change will allow them to visit with three of their four young relatives, who are ages 5, 4, and 2, if another adult is present, but not the fourth, who is an eight-week-old infant.
The judge scheduled a hearing for July 10 to check how defense attorneys are doing with their review of documents turned over by the prosecution.
