Grand juries are rare in Colorado criminal cases and extremely rare in homicide cases. According to the Boulder Daily Camera, only three Boulder County grand juries have been impaneled to investigate homicide cases in the last 20 years. All three met for more than a year. None returned indictments.
Veteran Boulder prosecutor Laurence W. "Trip" DeMuth III, who ran against Lacy for district attorney in 2000, told Crime Library, "Grand juries are often used by DAs to wash their hands of a case."

Thursday, three days before the one-year anniversary, Mary Lacy told Crime Library that she expects the grand jury, which has not been investigating any other cases, "will complete its work in the next few weeks."
She would not comment on whether she expected it to hand down an indictment.
Media Reaction
Alerted by Crime Library's coverage of the Jason Midyette case, several national television news analysts and commentators have expressed outrage at Lacy's handling of the investigation.

In January, Fox News's Bill O'Reilly said that if nothing had happened on the case by the one-year anniversary, he would call for Colorado Governor Bill Ritter, a former Denver district attorney, to exercise his legal authority to remove Lacy from the case and replace her with the state attorney general.
The move would not be without precedent.
