Ten-week-old Jason Midyette died March 1 from a severe brain injury, one week after his parents brought him into the emergency room of a Boulder hospital. Doctors later determined that Jason had 27 broken bones and a fractured skull. His parents, Alex and Molly Midyette, have refused to tell police what happened to their son and have retained separate attorneys.
Within a week of making his offer of assistance, Attorney General Suthers had Lacy's answer.

"We did hear back from her," Holtzman, the AG's spokeswoman, told Crime Library. "She said she feels like they have it under control."
So far no one has suggested that he will do it, but if the governor decides to instruct the attorney general to take over the prosecution of the Midyette case from Mary Lacy, his decision would not be without precedent.

In 2004 Gov. Bill Owens appointed then-Attorney General Ken Salazar, now a U.S. senator from Colorado, to replace District Attorney Mary Lacy (then known as Mary Keenan) as the lead prosecutor in a case involving the University of Colorado football program. The move came after a sworn deposition surfaced in which Lacy claimed that university officials used booze and sex to recruit football players.

Subsequent investigations by the attorney general and by an independent review board found no evidence to support Lacy's allegations. Nor was Lacy able to prove accusations that football players had raped female students. Lawsuits brought by the alleged victims were later dismissed.
