In another situation, sometime before Feb. 2, 2006, Alex and Molly disclosed to Alex's mother that Jason's upper gum had bled at least twice. The parents told Alex's mother that the baby's doctor had examined the injury with a metal probe and determined that it was not serious because the laceration did not penetrate all the way through the gum.
The baby's pediatrician, Dr. Jill Siegfried, disputed that claim and testified to the grand jury that Alex and Molly Midyette had never mentioned an injury to Jason's gums to her, and that she had never used a metal probe to examine any infant's gums.

Dr. John Meyer, the forensic pathologist who performed the autopsy on Jason Midyette, told the grand jury that the tissue tear he found between Jason's upper lip and gum was a common indicator of child abuse.
According to the indictment, the autopsy findings indicated that the brain injuries Jason suffered as well as the 27 bone fractures were in "various stages of healing," a clear indication that the injuries were inflicted at different times.

The report also indicates that Jason's parents knew he suffered from some type of injury or other problem with his left arm. Molly told her mother about the problem with Jason's arm and claimed she had informed Dr. Siegfried about it; however, Dr. Siegfried told the grand jury that neither Molly nor Alex ever mentioned Jason's arm to her. Jason's medical records do not contain any entry about his arm.
After Jason's death, the report notes, an autopsy revealed that among the dozens of fractures he had suffered, one was to his left forearm.
After Alex and Molly Midyette brought Jason to the hospital on the afternoon of Feb. 24, the report shows that they repeatedly denied they had dropped him or that he had fallen.
When doctors discovered Jason's multiple fractures, Alex became angry and repeatedly pointed out that Jason had no bruises.
The boy's parents did tell a doctor and a social worker at Children's Hospital in Denver that Jason had always had a "limp" left arm.
During Jason's treatment, both parents continued to maintain that Jason had been fine the day before they brought him into the hospital.
